These Terms of Service (these "Terms") govern your access to and use of Aila (the "Service"), operated by Lunar Guide, Inc. ("Lunar Guide", "Aila", "we", "us", or "our").

By downloading, installing, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

Important: Aila is a travel technology and intelligence platform. We do not operate airlines, rail operators, hotels, or other travel providers. When you book travel, you contract with the relevant third-party provider.

1. Definitions

  • "Provider" means any third party that supplies travel products or services (for example: airlines, rail operators, hotels, aggregators, payment processors, insurance providers).
  • "Content" means text, graphics, images, data, itineraries, recommendations, and other materials made available through the Service.
  • "AI Output" means any suggestion, recommendation, summary, itinerary, classification, or other output generated using artificial intelligence.
  • "You" means the individual or entity using the Service.

2. Eligibility and Account

You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Service. You agree to provide accurate, complete, and current information and to keep it updated.

You are responsible for safeguarding your account credentials and for all activity that occurs under your account. If you believe your account has been compromised, you must notify us promptly.

3. What Aila Does (and Does Not Do)

Aila helps you research, plan, compare, and (where available) book travel-related services. Aila may integrate with Providers to present availability, pricing, rules, and booking options.

Aila is not a carrier, hotel operator, tour operator, or travel agency of record unless explicitly stated for a specific transaction. Providers are responsible for fulfilling the travel services and for their own terms, policies, and operations.

4. Bookings, Provider Terms, and Your Contract

When you book through the Service (or are redirected to a Provider), you enter into a contract directly with the relevant Provider for that travel product or service. The Provider’s rules, restrictions, and policies apply (including change, cancellation, refund, baggage, boarding, check-in, no-show, and schedule rules).

You are responsible for reviewing and complying with Provider terms before booking and travel. If there is a conflict between Provider terms and Aila information or AI Output, the Provider’s terms control.

Prices and availability may change until a booking is confirmed. Aila does not guarantee that any price, fare, seat, room, route, schedule, or availability displayed will remain available.

5. AI Output and Travel Decision Responsibility

The Service may generate AI Output to assist planning and decision-making. You acknowledge that AI Output may be incomplete, incorrect, outdated, or unsuitable for your circumstances.

You are responsible for verifying critical details (including dates, times, locations, visa/entry requirements, health requirements, baggage rules, safety conditions, and Provider policies) before booking and travel. Do not rely on AI Output as professional advice (legal, medical, or financial).

6. Identification Information for Bookings

Some Providers require personal information to complete a booking, such as name, date of birth, nationality, gender, and government-issued identification details (for example: passport or national ID information).

We collect and use such information only when required to create, manage, or fulfill a booking you request, or as required by law. We do not permit access to such identification information by unrelated services. Access is limited to (a) you and (b) Providers or service partners involved in the specific booking workflow, or (c) lawful requests where we are legally required to comply.

How we handle personal data is described in our Privacy Policy, which is incorporated into these Terms.

7. Payments, Fees, and Taxes

If you pay through the Service, payments are processed by third-party payment processors. We do not store your full payment card details.

Providers may impose fees, taxes, surcharges, fare restrictions, currency conversions, and other charges. Refunds and chargeback outcomes depend on the Provider’s policies and applicable law.

If Aila charges a separate service fee for a transaction, it will be disclosed to you before you confirm the purchase.

8. Changes, Cancellations, Refunds, and Disruptions

Changes, cancellations, refunds, credits, and compensation requests are governed by the relevant Provider terms and applicable law. Aila may provide tools to request changes or cancellations, but the Provider controls the final outcome.

Travel is subject to disruptions and force majeure events (including weather, strikes, operational decisions, regulatory changes, emergencies, pandemics, or government actions). Aila is not responsible for Provider disruptions or force majeure impacts.

9. Acceptable Use

You agree not to:

  • misuse the Service, attempt unauthorized access, or probe or test system security;
  • scrape, harvest, reverse engineer, decompile, or attempt to extract source code or underlying models (except to the extent permitted by applicable law);
  • use the Service for fraud, unlawful activity, or to violate Provider terms;
  • interfere with the Service, Providers, or integrated APIs.

We may suspend or terminate your access if we reasonably believe you have violated these Terms or pose risk to the Service, Providers, users, or the public.

10. Intellectual Property

The Service, including software, UI, designs, branding, and Content (excluding any third-party content), is owned by Lunar Guide or licensed to us. These Terms grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal, non-commercial use (unless we explicitly authorize otherwise).

Provider names, trademarks, logos, and content belong to their respective owners.

11. Third-Party Services and Links

The Service may integrate or link to third-party services and content. We do not control third parties and are not responsible for their availability, accuracy, policies, or practices. Your use of third-party services is at your own risk and subject to the third party’s terms.

12. Disclaimers

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, secure, or that AI Output or Provider data will be accurate or complete.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LUNAR GUIDE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US (IF ANY) IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR (B) USD $100.

Some jurisdictions do not allow certain limitations of liability, so some of the above may not apply to you.

14. Indemnification

You agree to defend, indemnify, and hold harmless Lunar Guide and its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from or related to: (a) your misuse of the Service, (b) your violation of these Terms, or (c) your violation of any law or third-party rights.

15. Termination

You may stop using the Service at any time. We may suspend or terminate your access to the Service at any time if we reasonably believe it is necessary to enforce these Terms, comply with law, protect the Service, Providers, or users, or prevent abuse or fraud.

Sections that by their nature should survive termination will survive (including intellectual property, disclaimers, limitation of liability, and indemnification).

16. App Store Additional Terms (Apple and Google)

If you download Aila from Apple’s App Store or Google Play, additional terms may apply:

  • Apple and Google are not parties to these Terms and are not responsible for the Service, support, or claims related to the Service.
  • You acknowledge that Apple and Google may have their own rules and policies that apply to your download and use of the app.
  • If you are using the iOS app, you acknowledge that Apple has no obligation to furnish any maintenance and support services.

17. Governing Law and Venue

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict of laws principles.

Except where prohibited by mandatory consumer protection laws, you agree that any dispute arising out of or related to these Terms or the Service will be brought in the state or federal courts located in Delaware, USA, and you consent to their jurisdiction and venue.

Consumer rights: If you are a consumer, you may have mandatory legal rights under the laws of your country or state that cannot be overridden by contract. Nothing in these Terms limits those rights where applicable.

18. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will update the “Last Updated” date and may provide additional notice within the Service. Your continued use of the Service after changes become effective constitutes your acceptance of the updated Terms.
